That's not true; you don't even have to do that. The copyright notice isn't even necessary in a lot of countries (though it's still recommended)....

I'd guess it wouldn't be practical for you to switch hosting companies now, but Rackspace has a pretty good DDoS mitigation service called Preventier; from what I've heard it does work.
