    Weird situation

    I am getting a very slow response from both the ticket support and the other party (Godaddy copyright claims) on this issue, thus have decided to ask this question on the forums.

    I made the stupid error of running an unlicensed copy of VBulletin...I got reported, site got suspended. (Usually doesn't a website receive a warning before a file for suspension is put through?)

    I got caught completely off guard because I had been in the lazy set of mind of where (Ok, if i get a warning I'll buy the license) ..


    Well, I just did buy the license and my site is technically not breaking any copyright infringements now but GoDaddy copyright claims is asking this of me:

    Dear Sir or Madam,

    We are required by the DMCA to take down websites when we receive a
    copyright notification as was attached to our original email. Any
    information that may have been given to you contrary to that was
    incorrect. All hosting providers who wish to remain DMCA compliant will
    disable access for a site that is the subject of a complete copyright
    notification.

    At this point, if you wish to re-activate the site on our servers, you
    have 2 options.


    Option 1:

    ---------

    Remove the offending Content.

    In order to reactivate the site in question we will need you to provide
    the following information in a single email response:

    A. An electronic signature. (This can be a scanned copy of your
    physical signature, or as simple as typing your full name.)
    B. Identification of the material in question.
    C. A statement, under penalty of perjury, that the material has
    either been removed or will promptly be removed.


    Option 2:

    ---------

    Complete a Counter Notification.

    Submit a complete Counter Notification on the works in question in
    accordance with our Copyright Dispute policy. (See Above) You will need
    to reply, via email and include all of the following elements.

    A. An electronic signature of the Infringer. (This can be a scanned
    copy of your physical signature, or as simple as typing your full name.)
    B. Identification of the material that has been removed or to which
    access has been disabled and the location at which the material appeared
    before it was removed or access to it was disabled.
    C. A statement under penalty of perjury that the Infringer has a good
    faith belief that the material was removed or disabled as a result of
    mistake or misidentification of the material to be removed or disabled.
    D. The Infringers name, address, and telephone number, and a
    statement that the Infringer consents to the jurisdiction of the Federal
    District Court for the judicial district of Arizona, or if the
    Infringers address is outside of the United States, for any judicial
    district in which Go Daddy may be found, and that the Infringer will
    accept service of process from the Complaining Party or an agent of such
    Party.

    We understand that the very nature of these situations often involve a
    dispute over the content and/or the resulting infringement claim.
    However, we are a hosting provider, and must abide by the DMCA. We are
    not required to judge who is right or wrong in these cases.

    Since there is no copyright issue now...why don't they un suspend my account? I emailed them 8 screenshots of me now having proof for a valid VB license but they sent the SAME email back to me? What am I supposed to do? Everyone keeps asking me when the forums are going to be back up, and i can't answer because (technically they should be up) but I don't know when VB will drop the copy right claim issue (a ticket i have created) and when Godaddy will accept the fact that there is no copyright infringment presently...

    Any input?

    You could try sending them the license number, and let them ask vBulletin for verification of license status. Also explain to them you have purchased a license.

      First, you should ask Godaddy to temporarily enable your domain so that you may remove the illegal copy of the files on your server (Because even though you have a valid license, the license on your server at this time is not legal). Once you remove it and there is no site, show Godaddy that it has been removed. They will respond to vBulletin letting them know that you have complied with the takedown notice. Then, you should upload your valid licensed files to your server and run a upgrade (if required) and then your forum will be legal. As far as time goes, don't be surprised if no one is jumping to rectify your situation as you brought it on yourself by using a pirated copy of vbulletin...

        Do you have the url registered at godaddy in addition to the hosting account?

          Dismounted- Iv'e done all of this.. I basically emailed copyrightclaims 8 attachments.. 3 of the emails I get initially from buying it...The customers area screenshot and misc screenshots of license ownership to Session One.

          I just found out that a request has been put through to pirate reports.. I just fwd the emai with the attachments to the agent too who is representing this case.

            Well from what i understand...I don't need to remove content now as I have a valid license to run on S1. I need them to unsuspend my account first of all to do anything.. I don't really get what your saying as a moderator didn't even imply i need to remove the files and start from scratch..

              The most important bit of information is the license number. Make sure you've set the URL correctly in the Members' Area as well.

                  you mean in the customers area? Yeah, Iv'e done that.

                  www.sessionone.net is the url for the attained license number

                  I have made sure of this..but I guess godaddy needs proof from vb or whatever they need..they won't listen to a word i say.

                      I can't even access cpanel yet..I want to make a backup of my old members/posts/etc before i install my licensed version.

                      So what your saying is that I need to delete my old copy of vb since it is a redistributed one right? But i can still save the important stuff from it and incorporate it into my new forum?

                        Well you are stuck until you can get your data, or start over.

                        Keep in mind I am not an expert at all. Bold part: I would delete old vb files once you are sure all modified files (if any) were accounted for. Red part: that would be the database and all customized files.

                            Those are the basic concepts. If you are a licensed vb owner then you should have access to the other licensed owners areas where you could ask questions. If your account is not enabled for those areas yet you may want to send a support ticket. Keep in mind this has been a tremendously difficult week and the support people are quite probably tired. In any event to get the data you need to get the account re-enabled which was the entire point of this thread. Personally I would at least try to call them on the phone and talk to a human, they may be able to do a little more (or not).

                            Godaddy seems to respond to complaints more than other hosting providers i.e. I would seek another host that would at least attempt to contact you prior to your account being suspended.
