Tools.php ?

Is tools.php the same as usertools.php ? I'm trying to fix a cookie issue from a friends move to another server ( ya he didnt do it right). Cant seem to find tools.php , only usertools.php . Its version 3.08

No, it's not. The tools.php file is in the 'do_not-upload' folder of the zip file.
