There is no way around this in the system because when the check is made, a smilie is just text to it. 4 smilies would be 8 characters on most systems.

You would need custom validation for this. You could ask at www.vbulletin.org to see if someone has done something similar. You could also handle this with moderation and community policing so that your users learn what is acceptable in the community.

Is there any way of making it so that members have to post some text, not just smilies.

I've got the minimum number of letters set to 8 - but some members are just posting smilies no words.
