It is my understanding that you need to display the Powered by: vBulletin if you use vbulletin, is this correct?

it is just that the forum at (edited) looks very much like VB but is not displaying Powered by: vBulletin

You can buy the removal of that.

You can remove the 'powered by' in the title. What needs to remain in place is the copyright info in the footer template. At a minimum the copyright must read:

vBulletin, Copyright ©2000 - 2003, Jelsoft Enterprises Limited.

Not to be an A$$ but what if someone does not display the code? Is it the same as piracy? (My site does have it)

Yes it is, unless they purchased the Branding Free license, which will allow them to remove it.

            From the license agreement:

            http://www.vbulletin.com/license.html

All vBulletin copyright notices within design templates must remain unchanged (and visible).

Technically that should probably be edited to only mention the footer because, as it was just said, the <title> mention of vB on forumhome can be removed.

It says copyright notices, not mentions of vBulletin...
