Well its a funny one really, because you can look at it this way. Jelsoft say that they offer no support for hacks over at vB.org. So they are seperating themselves from that sites hacks. Also the hacks released at vB.org by members there do not belong to vB.org, but rather the members there who created them and simply choose to use there site to advertise there hacks. So technically speaking you could argue "No". It's up to the creator of the hack to do something about it if there hacks are found posted for download on another site. And it doesn't really involve neither Jelsoft or vB.org in a sence.

But I supose vB.org would take action if they found out a member there was taking hacks to post on another site. Maybe there Forum Agreement states that members cannot take hacks from there site to advertise on another site posted there. Not sure!

Coders can release their hacks wherever they like.

If someone downloads hacks from .org and redistributes them himself without permission by the original author, then that's an intellectual property violation, which isn't allowed per our license agreement:
The Software may not be used for anything that would represent or is associated with an Intellectual Property violation, including, but not limited to, engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities.
