    My daily spam

    Received yesterday the follow email form a guy that first spammed my board with his product announcement and then threat me because of the negative feedback:

    DSP Global Services and the Windows Lite Team on behalf of Travis Mills and James Dulmage are hereby sending out a warning notice about the actions that some users of NT Compatible's forum are taking against our company and it's products.

    We will be forced to take legal actions if this is not stopped immediately, I bring to your attention something called "Libel-Slander". When a person or persons writes or types negative comments and/or information directed solely on hurting the company or persons involved.

    At NT Compatible, the URL:


    contains negative information and comments directly based on hurting the company, one of such is from the user, Toby. Among other users, DosFreak, kyguy, and so forth.

    While there is nothing I can do to stop them, NT Compatible has the rights to ban, block or disallow the posting of these comments and/or ban the party involved.

    We are giving you a choice, disallow this immediately and we will push back, but continue to allow this and we will be forced to take legal actions against NT Compatible and possibly against the persons involved.

    If you wish to discuss this further, please feel free to e-mail me with your questions and comments.

    Also, I forgot to add in that my lawyer and our companies will be monitoring your site and it's forum for the next 12 months now and we may go forward with our plans and be charging NT Compatible for Libel-Slander against the companies involved, since I no longer can post there anymore, I feel no reason to prevent this, you obviously are hiding behind your php scripts, instead of allowing me to continue to post. Your just mad because your in trouble, so you banned us. We will keep you posted, but be warned that your probably going to be going to court within the next year or so because of Libel-Slander and because of the fact that you banned us from your forum without warning, at least we gave you guys a warning. I'll keep you posted then.
    My Lawyer and I just finished talking, we are going to hold back for a little while....and I want my account back on NT compatible too, I did nothing wrong, nor was I warned, you just pissed off because of the chance that you'll be sued, which I won't bother doing if we can come to some terms on the content of NT Compatible.

    If you have the proof that he spammed and it broke the forum rule, no problem. Then he is a jerk.
    If you have the proof(screenshots and such), tell him to get the layer. it probably cost'em way more than dealing you via e-mail.

    He appears to be speaking for whatever his company is. Talk him personally. Tell him what he did wrong and if he agrees, I think it is ok to unban his account. If not, forget about him. (Don't forget to save the content of e-mails.)

      If he's spammed your site he deserves all he gets.

      Question is though, did you actually remove the spam or did you let your users respond to it - negatively I expect. Even so aren't posts the responsibility of the poster and not the forum owner?

      I can't believe the attitude of spammers some time when you just delete their post and they take it as a personal insult against them.

        Probably he doesn't realize that he is a spammer. He may not even know what spam means.

          Yes the message was 2 days up. I have usual no problem with advertisement as long my visitors are interested. There was only a few answers negative.

          Tell him what he did wrong and if he agrees, I think it is ok to unban his account.

            Ah right I see. In this case he has no case whatsoever. By posting the message on a discussion forum he is effectively opening up is company and his products to discussion and critisism. Whether that is good or bad is at his risk and his risk alone and not for you to police peoples opinions about his company. People often write into newspapers, go on TV etc complaining about a specific company there is nothing legal a company can possibly do to prevent that.


            In fact it could be argued that if you did remove negative comments towards his site than his competitors could complain that you were favouring him.

            I hope you have retained this material.

            My advise. Chill out and relax, he has absolutely no basis for any claim against you. Keep him banned and ignore (but keep) any email he sends you.

                Solution:

                1. Pull his IP from his post.
                2. Send him a trojan over his e-mail.
                3. Log into his computer and nuke his HD.

                Of course, when I have done this to people they always retaliate with similar actions.

                Offender - "hey Jakeman! I'm deleting your Windows directory right now! HAHA!"

                Me - "Macs have Windows directories?"

                Offender - (no comment, never heard from again)

                I hate lamers.

                  A few guys on IRC, along with my advertising, hosting and beta testing that i'm doing are creating Windows XP Lite. It's already in Beta 1 stages and once the site is fully up, I will post it.

                  Just curious, how many people here would love to see it?
                  the features are as follows so far:
                  auto restart shell when explorer crashes (never does anyways)
                  broadband optimiziations (tweaks up your internet)
                  clear pagefile at shutdown
                  turn off File Protection
                  split windows explorers (reduces ram usage)
                  windows media player 8 kbit upgrader (allows you to encode .wma files at a higher rate than only 64bit. Now you can get up to 192bit wma and 128 mp3
                  internet explorer removal (that's still in development)
                  FreeRam - uninstalls a bunch of unuseful extensions to free up ram
                  Shrink - if you don't use Help files, screensavers, media, oobe, temp directory, welcome windows and discovery, sounds, log files and readme files. This program will delete about 500 MB of files out of your windows folder.
                  Services - allows you to set them to Manual, Automatic or Disabled
                  Tweak UI XP - need I say more?
                  ASPI Layer - Allows you to check and then install the ASPI layer for Windows XP
                  Shell Swap - Allows you to use Windows Neptune, Windows XP, Windows 2000 or Windows NT 4.0 shell and interface.

                  What sort of broadbrand optimizations? Does it offer all of the features that other freeware proggies do and as well? Check out www.tweakfiles.com. Can your prog do the same? Ask yourself what sort of tool you are making? Win Lite or Win DOITALL?

                  Usefull....but not really. Any program that worth it's salt installs it's ASPI or has one internal. EZ CD for instance doesn't use an external ASPI anymore but CDRWIN still does.

                  Please do. Mabye you can add the Add/Remove Programs control panel to your program? Mabye the addition and deletion of devices from Windows Whistler?

                  Everything I see you mention above has been done before and will be done again by people who have already done it before....better I might add since they have been doing it longer. Why not do something that has not been done before?

                  The deletion of extra files, management of ASPI layer, and the Shell Swap sound reasonably good.

                  How about controlling the installation/removal of programs for Windows Whistler/Windows 2000 in a better fashion. Check out the \INF directory. There are plenty of .INF'S there and you can do AMAZING things with them. I've wanted to go through them and I even cataloged them when 2000 was in beta but I've sadly never had the time to finish and modify them to my satisfaction. Catalog 'em and then offer options to install/uninstall the exact programs using Windows 2000's install/uninstall in the .inf's themselves.

                  MANAGEMENT OF ASPI LAYER
                  There isn't much to this one. Heck all I do is use ForceASPI. Run one little batch file and TADA! ASPI files are copied into their appropriate directories. (I had my own batch file that did it before but I'm lazy). Not sure what your proggy offers that this doesn't......

                    I'm not sure what you are worried about. For one, you are the webmaster. You have the right to ban if you feel the need to for any reason. I would hope that you would reserve banning for those in need of it though. What I have done is included the forum rules in every forum. Click on my link below and go check out the rules. Simply put, if you have the rules set up, then they have been warned from the get go. Anyone posting warez or links to warez would be banned immediately. The rules of engagement with your host is that you, the account holder is responsible for what hits the server hard disks. I'm sure a host would use discretion when enforcing this policy, but you never know. As far as a law suit. What a joke. I don't know too many organizations such as he claims to be posting warez on boards.

                    You might try my idea of how to implement the forum rules. Then no one can say they never knew. I think a great vB hack or feature would be an administrative warning system. A 3 strikes your banned type of thing. You wouldn't put this in the rules, but rather use your discretion as to giving them a warning and the CP holding this information. Next one, click down one to number two and give your reason for the second. Third time auto bans the IP you input. You could also jump straight to a ban if the offence was great enough to warrant it. Each offenses info and status would be preserved in the control panel db and the explanations for them. Each offence would be auto emailed to the user with the explaination of why the decision was made. (just a thought. I get those sometimes. Just wish I could program this and then hope I would never need it.)
